CONSUMER WINS AT TRIAL AGAINST ARROW FINANCIAL

Debtor defense lawyer, Micah Adkins, won at trial today against Arrow Financial.  The plaintiff, Arrow Financial, LLC,  accused the unnamed defendant of breach of contract for failure to make payments on a GE Money credit card.

The unnamed defendant was a victim of identity theft and never opened the account or authorized anyone to open the account in the defendant’s name.  Arrow Financial continued to try to collect the bad debt from the defendant even after it was presented with a police report and sworn affidavit stating the account was opened as a result of identity theft.  Nonetheless, Arrow Financial moved forward with trial.

“At trial, Arrow failed to present any evidence of the defendant’s liability on the account.  In fact, Arrow Financial did not even send a corporate representative to the trial or provide the judge with any supporting documents,” says debtor defense lawyer Micah Adkins.
